Students do not shed their First Amendment rights at the schoolhouse gate. The First Amendment protects students’ rights to express their religious, social, and political opinions in public school, orally, in writing, through their dress, or using other expressive conduct intended to convey a particular message. However, First Amendment rights are not absolute. In some instances, school districts may regulate student speech, depending on the circumstances and nature of the speech involved. In this respect, school officials are often faced with situations where they need to address speech that may be threatening or disruptive in nature. In those instances, school officials must balance student free speech rights against competing concerns, including the need to provide a safe and productive educational environment for all students.
