Incidents of violence on college and university campuses have heightened the need for increased safety measures on these campuses. One safety measure often utilized is to conduct background checks of each employee hired within the college or university. However, college and university officials must be aware of the legal implications associated with background checks, particularly when the official wishes to deny employment to an applicant who has a criminal arrest or conviction. The Equal Employment Opportunity Commission (EEOC) have cautioned employers from having policies or practices that screen individuals based on criminal records, because such screening may amount to disparate impact discrimination.
