Truancy Troubles: Understanding the Legal Issues and Dealing with Chronically-Absent

Absenteeism can cause significant problems for school systems. High rates of absenteeism within a school system can have a negative impact on student test scores, ultimately affecting the school’s accountability rating. Chronic absenteeism can also have a devastating impact on a student’s academic success. Students who are chronically absent from school for medical reasons may have rights under Section 504 and/or the IDEA and may be entitled to disability-related accommodations. In addition, students who are chronically-absent for non-medical reasons can often develop anxiety and school-phobia symptoms that may ultimately result in disability rights protections. Overall, truancy is not only disruptive to the individual but to the classroom as a whole.
