ADA Compliance Obligations

The Fair Labor Standards Act (FLSA) sets minimum wage, overtime pay, equal pay, recordkeeping, and child labor standards. The Department of Labor (DOL) promulgates rules related to the FLSA and also enforces the FLSA and its regulations. School districts must comply fully with the FLSA, but such compliance is often challenging, especially with the many changes in this area. In this respect, there have been many developments from the DOL under President Trump, including proposed rules from March 2019 to change aspects of white collar exemptions. Schools must be prepared for these changes, particularly increases to the salary levels for these exemptions. Failure to adapt to these changes and follow the FLSA can lead to significant penalties, including attorney fees and other damages.
