Since 2011, the Department of Education (ED), Office for Civil Rights (OCR) has focused on the ways schools and campuses have addressed sexual misconduct reports. School districts and universities have since worked diligently to develop and implement policies and procedures, trained employees and Title IX teams and raised awareness on related sexual misconduct topics. Those efforts, for many campuses have not been easy.

While the previous administration's efforts brought widespread awareness to campuses regarding our responsibility to address sexual misconduct when it was reported, that awareness and the subsequent Guidance and DCLs also caused some confusion on what the ED's expectation of schools and universities were. While the 2011 face of Title IX compliance seemed to favor a more victim-centric approach to addressing sexual misconduct issues, recent legal challenges by respondents (and subsequent rulings in their favor) have garnered the attention of the current administration. On November 29th, 2018, ED published the proposed federal regulations that would alter current Title IX compliance requirements for many.

Since then, over 124,000+ comments have been provided to the Department of Education for consideration on this important topic. In May of this year, the current stage of the proposed regs went from “Proposed Rule” to “Final Rule” (according to the regulations.gov website) with a “Final Action” date listed as “09/00/2019.”
