Medical Leaves of Absence: Issues Surrounding Voluntary and Involuntary Withdrawals

Two common, recurring scenarios have inspired this essential webinar.

Scenario One: The semester is drawing to a close. The “drop” period is long past. A student appears in the dean of student’s office with a request to take a voluntary medical withdrawal, claiming that a medical condition prevents her from completing the term’s coursework.

Scenario Two: Another student has been treated at the college health center for injuries that suggest self-harm. A friend in his residence hall reports to the RA that the student has expressed suicidal ideations.

Should the first student be allowed to withdraw and take a medical leave of absence? Should the second student be required to do so?

Answering these questions correctly can mean the difference between a favorable outcome and a lawsuit... or even between life and death.

Other comparable scenarios concern the student who seeks a voluntary medical leave on the cusp of a disciplinary hearing; the student who seeks readmission following a medical leave of absence and lacks the requisite release from a treating physician or psychologist; and, the student whose disability, such as Asperger Syndrome, has led to confrontations with students and faculty who are now fearful of the student’s continued presence. How should you handle each of these all-too-common cases within the bounds of the law and best practices?
